Canada Citizenship Rules Change: U.S.-Born Descendants May Already Be Citizens

Recent changes to Canada’s Citizenship Act have created a surprising reality: many individuals around the world may already be Canadian citizens without knowing it.

Following the implementation of new legislation in late 2025, eligibility for Canadian citizenship by descent has expanded significantly. However, even if someone qualifies, they still need official confirmation from the government.

This is where Proof of Citizenship becomes essential.

What Is Proof of Citizenship?

A Proof of Citizenship, officially known as a Citizenship Certificate, is a legal document issued by the Government of Canada confirming that a person is a Canadian citizen.

It is required to:

  • Apply for a Canadian passport
  • Access full citizenship rights
  • Confirm legal status in Canada or abroad

Even if someone is already a citizen by descent, they cannot use their citizenship officially without this document.

Why This Is Happening Now:

Due to major updates under Bill C-3, Canada has removed the long-standing “first-generation limit” for citizenship by descent in many cases. As a result, individuals born outside Canada may now qualify through their parents or even grandparents. Some people who were previously excluded under older rules are now being recognized as Canadian citizens, and large numbers of applications for citizenship confirmation are currently being submitted. According to CIC News, this change has led to a significant surge in individuals discovering that they may already be Canadian citizens.

What Changed Under Bill C-3?

The major shift in Canadian citizenship law includes:

1. Removal of the First-Generation Limit (for eligible cases)

Previously, citizenship could only be passed to the first generation born outside Canada.

This restriction has now been lifted for many individuals born before December 15, 2025.

2. “Lost Canadians” Are Now Included

People who were previously excluded due to outdated legal rules may now be recognized as citizens.

3. New Rule for Future Generations

For children born after December 15, 2025, citizenship by descent is still possible but requires a stronger connection to Canada, typically:

  • At least one parent with Canadian citizenship

  • Proof of 3 years (1,095 days) physical presence in Canada before the child’s birth

  • Increased awareness of citizenship by descent

How to Apply for Proof of Citizenship

The application process generally includes:

Collect Required Documents
  • Birth certificates
  • Proof of Canadian parent or ancestor
  • Family lineage documentation
Submit Application to IRCC

Applications are typically submitted online through Immigration, Refugees and Citizenship Canada (IRCC).

Processing Period

Due to high volume, processing can take several months.

Receive Citizenship Certificate

f approved, you will receive a Citizenship Certificate confirming your status.

What Happens After Approval?

Once you receive your Proof of Citizenship, you will be able to apply for a Canadian passport, live and work in Canada without going through immigration procedures, and enjoy the full rights of Canadian citizenship.
